COPPER NETWORK TRANSITION – TERMS & CONDITIONS

1. ELIGIBILITY

1.1. This offer is available only to existing Telecom customers who are currently subscribed to an eligible Telecom Fiji copper Broadband service and are being transitioned to Telecom Mobile Broadband as part of Telecom Fiji’s network transition programme.

1.2. This offer is not available to new customers and is not available for direct sale.

1.3. The customer’s existing monthly Broadband rental will remain unchanged as part of the transition, subject to the applicable plan and service conditions.

2. MOBILE BROADBAND MODEM & TERMS OF SERVICE

2.1. As part of the network transition, an eligible customer will be provided with one Telecom Mobile Broadband Modem at no cost.

2.2. The complimentary Modem is provided subject to a minimum twenty-four (24) month commitment to the customer’s Mobile Broadband service.

2.3. The twenty-four (24) month commitment commences from the date the customer’s Mobile Broadband service is activated.

2.4. The customer must remain on the applicable Mobile Broadband service for the full twenty-four (24) month commitment period.

2.5. If the customer chooses to disconnect the Mobile Broadband service or switch to prepay before completing the twenty-four (24) month commitment, an early termination charge will apply.

2.6. The early termination charge will be based on the remaining unamortized cost of the complimentary Mobile Broadband Modem, calculated on a prorated basis over the twenty-four (24) month commitment period.

2.7. Any outstanding charges on the customer’s account remain payable in addition to the early termination fee.

3. MODEM CARE, WARRANTY & REPLACEMENT

3.1. The Mobile Broadband Modem remains the customer’s responsibility for the duration of the commitment period and must not be sold, transferred, disposed of or otherwise given to another person.

3.2. Where a fault with the Modem is confirmed to be a manufacturing or equipment fault covered under the manufacturer’s warranty, Telecom Fiji will arrange repair or replacement in accordance with the applicable warranty conditions.

3.3. Warranty coverage does not apply to damage or faults resulting from negligence, misuse, abuse, incorrect installation, power surges, natural disasters, liquid damage, loss, theft or other customer-related causes.

3.4. General wear and tear is not considered a manufacturing fault and is not covered under the warranty.

3.5. Where a Modem requires replacement due to damage, loss, theft, negligence, misuse or other circumstances not covered by warranty, the customer may be charged the applicable replacement cost.

4. DEPOSIT & CREDIT REQUIREMENTS

4.1. Telecom Fiji may require a deposit for the Mobile Broadband service depending on the customer’s existing deposit balance and/or credit history.

4.2. Any applicable deposit will be advised to the customer prior to activation of the Mobile Broadband service.

5. SERVICE, SPEED & COVERAGE

5.1. The Mobile Broadband service is provided over the Telecom mobile network and is subject to network coverage and availability at the customer’s service address.

5.2. Depending on network coverage and availability at the customer’s location, the Mobile Broadband service may operate over 4G and/or 5G. The network technology available to the customer may vary based on location and other network conditions.

5.3. The speeds advertised or associated with the customer’s plan represent theoretical maximum network speeds. Actual speeds may vary due to factors including network configuration, signal strength, location, premises interference, network traffic, hardware and software.

5.4. Telecom Fiji can only guarantee internet speeds from local content or to local speed test servers. Internet speeds to content outside Fiji, including offshore speed test servers, are not guaranteed.

5.5. There may be locations within the Telecom mobile network coverage area where signal strength is poor or unavailable due to factors beyond Telecom Fiji’s control, including terrain, buildings and other environmental factors.

6. BILLING & GENERAL CONDITIONS

6.1. The customer’s existing applicable Broadband billing, data allowance, portal and usage conditions will continue to apply to the Mobile Broadband service unless otherwise advised.

6.2. The customer remains responsible for payment of all monthly rental and other applicable charges in accordance with their existing billing arrangements.

6.3. Telecom Fiji reserves the right to suspend or terminate the service in accordance with its applicable service terms where there is non-payment, misuse of the service or breach of these Terms and Conditions.

6.4. These Terms and Conditions are governed by the laws of the Republic of Fiji.
